Oracle Corp (NYSE: ORCL) has reported net deferred tax assets of $6.5 billion as of May 31, 2023, compared to $6.8 billion in the previous year, according to the company’s recent SEC filing. The company attributes the realization of its net deferred tax assets to its ability to generate sufficient taxable income in future years in appropriate tax jurisdictions.
Furthermore, the company stated that it had federal net operating loss carryforwards of approximately $380 million as of the same date, subject to limitations on their utilization. Around $304 million of these federal net operating losses will expire between fiscal 2024 and fiscal 2038, while the remaining $76 million are not currently subject to expiration dates.

In addition to the federal net operating loss carryforwards, Oracle had state net operating loss carryforwards
These carryforwards total around $2.2 billion as of May 31, 2023. They are set to expire between fiscal 2024 and fiscal 2043, also subject to limitations on their utilization. Meanwhile, the company’s foreign net operating loss carryforwards stood at about $1.9 billion as of May 31, 2023.
Regarding the tax credit carryforwards, Oracle had a total of roughly $1.4 billion as of May 31, 2023
These carryforwards are again subject to limitations on their utilization. Approximately $933 million of these tax credit carryforwards are not currently subject to expiration dates, while the remainder, totaling around $438 million, will expire between fiscal 2024 and fiscal 2043.
Oracle also disclosed that it had federal capital loss carryforwards of approximately $141 million
These carryforwards will expire in fiscal 2026. Furthermore, the company had state capital loss carryforwards of around $314 million, set to expire between fiscal 2026 and fiscal 2036.
In terms of unrecognized tax benefits, the total gross amount as of May 31, 2023, was $7.7 billion
The interest and penalties accrued as of the same date totaled $1.7 billion. The company noted that it is currently under audit by the IRS and other domestic and foreign tax authorities concerning income tax and indirect tax matters. Oracle is involved in various challenges and litigation in several countries, including Australia, Brazil, Canada, Germany, India, Indonesia, Israel, Italy, Mexico, New Zealand, Pakistan, Saudi Arabia, South Korea, and Spain.
Oracle believes that it has adequately provided for potential outcomes related to its tax audits under GAAP. Nonetheless, there can be no assurances regarding the possible outcomes or any related financial statement effect thereof.
